How can I get citizenship after DUI and expired green card?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A single DUI conviction for which you supplied court-certified disposition documents (showing the court order, showing you paid the fine, completed probation, etc.) should not have interfered with your eligibility to naturalize four years ago, and it should not stand in the way of eligibility now. Regarding your expired "Green Card," you should be prepared to supply a copy of the Receipt Notice issued by the USCIS. It would be wise to work with an immigration attorney in connection with the naturalization case (I suspect that if you had done so four years ago, your application could have been approved).

My husband has been unemployed for 5 months, should I go ahead and file for citizenship anyway?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Sorry to hear that your husband is having trouble finding employment, but don't let that stand in the way of you applying to become a naturalized citizen, assuming you otherwise are eligible - his employment status is completely irrelevant.

If my parents have visitor visa once they enter the US do I have to file both the I-130 and I-485?

Answered by attorney Richard Stephan Kolomejec (Unclaimed Profile)
Immigration lawyer at Richard S. Kolomejec
You should file both the I-130 and I-485 at the same time. But wait a couple of months after their last entry. Filing too early can sometimes look like visa fraud. In other words, you are not suppose to use your tourist visa to come to the US and stay. You should always consult with an experienced immigration lawyer first.
