Can my husband be legalized if I am disabled?

default-avatar
Answered by attorney Kripa Upadhyay (Unclaimed Profile)
Immigration lawyer at Orbit Law, PLLC
Yes. Although the process that he and your family would have to go through would be different based on your legal status and the facts of the case. If he entered the country legally i. e with a valid visa then he may be eligible to adjust status based on a petition you file for him as the spouse of a U.S. Citizen (if you are a Citizen). If he entered illegally then he may still be able to receive Lawful Permanent Residence but the process would be different. It is difficult to give you a detailed answer to your question since the process you will need to follow depends on various factors that you have not provided information on. Please contact an Immigration attorney in your area for advice regarding the particulars of your case.

How long is the waiting period for withdrawing an I-130 visa petition?

There is no waiting period to re-apply after withdrawal. The case will be matched with the previous filing, so why are you re-filing?

What should I do if my visa is about to expire and I'm waiting for divorce decree?

default-avatar
Answered by attorney Yahima Suarez (Unclaimed Profile)
Immigration lawyer at Hernandez & Suarez, PL
You must file on time with or without the divorce decree. Just to make sure, you received temporary residency status not a visa, correct? In that case, then you must file. Once you have the interview, you may already have the divorce decree or just inform immigration of the status of the case. Immigration will not be so concerned with your divorce, but with proof that your marriage was valid ab-initio (when it started). I would recommend you hire the services of counsel to help you with this matter.
