What are the chances to get deported for a federal crime, at the same time an aggravated felony?

Alexander Joseph Segal

Chronology could be important. As a general matter the chances are close to 100%. Such person is subject to mandatory detention and mandatory deportation with very little relief available. Such relief would come in a form of very limited protection of a deferral of removal under the UN Convention Against Torture.

There are two routes depending upon if the Canadian in the U.S. or in Canada: 1) adjustment of status or 2) she leaves the U.S. and they do consular processing.   If she is in Canada then there are two routes: 1)  U.S. Citizen marries her in Canada [if this is a same-sex marriage, make sure that Canada allows it], then petitions her and she consular processes or 2)  Fiancee visa (K-1).

Your mother will have to become a citizen and then petition for you. After she files a petition for you, you and your family will have to wait about 6 years before you are eligible to apply for green card.
