A person born in the U.S. becomes a U.S. citizen by birth, regardless of the parents' nationalities or immigration status, and this remains true even if the child lives most of his life outside of the U.S. The U.S.-born person may file an application for a Certificate of Citizenship to obtain documentary evidence of his/her status as a U.S. citizen, and with the Certificate of Citizenship may apply for a U.S. passport. In many instances, a U.S. citizen who has reached age 21 would be able to petition for other family members, such as parents, to obtain immigration status. It would be wise to consult with an immigration attorney about the details, in order to confirm eligibilities and to address options and strategies.

Yes it will be. A problem, and yes, if your income is zero, that's what you put on the I-864. You will also need a co-sponsor.

Generally a foreign national's single DUI arrest will not stand in the way of eligibility for a marriage-based adjustment of status application process. It will be necessary, however, to provide the USCIS will court-certified copies of all disposition documents relating to that arrest. It would be wise to consult with an immigration attorney who, after seeing the disposition documents and learning all of the relevant information about you, your husband and your marriage, would be able to advise you about eligibilities, options and strategies and offer representation for you and your husband in the application process. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
