Yes, you can change your status to a B1 while in the US. It will be limited to 6 months maximum. If you are outside the US, then you would apply directly that the Embassy for the B1, but they will be suspicious why the company had an H1b, cancelled and then did a B1.

You may have derived U.S. citizenship from your mother, but it depends on a number of factors including the time that your mother spent in the United States. You may need to provide other documents and evidence of your mother's residence in the U.S. If you don't have those documents, an immigration attorney or private investigator may be able to help you find those documents. I recommend that you consult with an immigration attorney to determine whether you derived citizenship from your mother.

In a marriage-based adjustment of status application in the Immediate Relative visa category, the foreign national's previous criminal offenses must be revealed to the USCIS, and the foreign national spouse should plan to supply to the USCIS a full set of court-certified case disposition documents. With that, the traffic offenses should not stand in the way of eligibility to become a Lawful Permanent Resident (to get a "Green Card"). Note that improper completion of the application or the supplying of insufficient supporting documents can cause substantial delay or even more harsh consequences, and it would be wise for you and your husband to work with an immigration lawyer.
