You state that your IV (immigrant visa) issue date was December 23, 2012 and that the visa expires on October 1, 2012. I suggest that you or your representative contact the Embassy and request correction of the immigrant visa. An immigrant visa when issued is to have 6 months validity from the date of issuance. What are the requirements I will need when applying for US citizenship?

Answered by attorney David H Nachman

The N-400 directions are relatively clear - the form tells you what to include. In addition to the documents that you have listed, we also recommend photos and proof of tax payments. If you would like to have the complete document reviewed before submission, please feel free to contact us for an initial consultation. Please note that the Form was recently updated and that soon you will have to be using the new N-400 Form.

Answered by attorney David H Nachman

Thank you for your interesting inquiry. The issues are quite complicated and the matter depends upon the stage that the husband's case is in. We have handled many cases of this nature and work closely with the Matrimonial Counsel and the parties to explore all potential options. It would be best for your friend to contact a qualified Immigration Law Office/Firm and to be sure to explore ALL of the options available with regard to timing and possibility for completing of the process.
