What If Applicant is denied a US Immigration visa can his child enter if approved?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The answer depends upon whether the visa applications are separate standalone applications or whether the child is filing under a dependent status. If the first, he or she may be able to receive the visa without you; if the second, he or she must await your result. Is it illegal to marry someone for immigration paper without them knowing?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Although not entirely clear from your question, it sounds like you are asking about a marriage entered for the purpose of getting a "Green Card." That would constitute visa fraud with potentially very serious consequences for both the foreign national and the U.S. citizen. Regarding verbal abuse, if a couple enters a genuine, bona fide marriage, and the U.S. Citizen subjects the foreign national to abuse, the foreign national may not need to remain in the abusive relationship in order to secure immigration benefits, and instead may qualify for relief under the Violence Against Women Act ("VAWA"). In order to assess eligibilities, options and strategies, there is no substitute for engaging an immigration attorney to learn all of the relevant details and circumstances.

On the I-129 form, it gives the option for my alien fiance's U.S social security number, what do I put down?

Alan Rodolfo Diamante
Answered by attorney Alan Rodolfo Diamante (Unclaimed Profile)
Immigration lawyer at Law Offices of Alan R. Diamante APLC
If no social, just say "none". G-28 is an appearance letter from an attorney or representative. If none, do the same.
