Normally there is no problem with getting a marriage license and going through the ceremony. Once he is married, the inspectors at the border may begin to question his intent if he tries to enter as a visitor or non immigrant. I would suggest going through either an adjustment of status or consular process to make him a resident once you are married. Both processes can take 8 months to a year or more.

Assuming you are married to a U.S. citizen you are an immediate relative and the failure to maintain status will not be a reason to deny your permanent residency. Were you ever picked up by ICE?
