Can I file an immigration petition my whole family at the same time?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You can petition your father since you are a U.S. Citizen. However, you cannot petition your step-mother or step-brother because she married your father after your 18th birthday. You would have to petition your father, and after he becomes a LPR he can petition them, which will take 3-7 years.

Will my felony case be a problem applying before my court date?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You need to speak to an immigrant attorney BEFORE you plead to anything regarding your criminal matter. Many convictions, especially felony convictions, could lead to you being deported. As for filing for Naturalization, your application will not be approved until the pending charge is resolved. If the charge results in a conviction it is likely your naturalization application will be denied, and it could result in USCIS trying to deport you. Again, you must speak to an immigration attorney regarding this matter since any conviction could have serious immigration consequences.
