Can my husband file a petition for me if he did not file taxes for the last 4 years and he was gainfully employed?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If your husband was gainfully employed and did not file taxes for the last four years, he is in violation of the tax laws. Without a record of having worked, it would be difficult for your husband to file for you and for you to pass the public charge ground of inadmissibility. If he really wishes to do so, he should consult an accountant or tax lawyer who can advise as to whether he can file late tax returns and the penalties for doing such. What do I do about my expired F2 visa?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
To apply for a change of status, you normally must still be in status when the application is submitted. Unless you have received written notification that the F1 status has been terminated, you can submit the application and supporting documentation on form I-539.

Is there a parole applicable for me to stay in the US?

default-avatar
Answered by attorney Myron Russell Morales (Unclaimed Profile)
Immigration lawyer at Quan Law Group, PLLC
You should consider filing an application to recapture any time that you have spent outside of the U.S. during your H-1B validity period. This should give you enough time to get another PERM on file. Also, depending on your job, you may want to consider an EB-2 with a National Interest Waiver.
