How to add a new born to a pending I-130 petition?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
As you are a US citizen, you filed a non-quota immediate relative petition for your wife which has no allowance for dependence. Your best action at this point is probably to file an I-130 petition for your newborn baby and the two cases can hopefully be joined together at the NVC or at the US consulate or embassy. This is not an uncommon situation, and you or your attorney can slow down your wife's case in the consular processing stage to allow your newborn baby's case to join up.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Does ur firm address asylum seeking due to female circumcision

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
I handle asylum cases, but I have never represented someone with a FGM claim.  I would be happy to take your case, or refer you to someone with experience in FGM cases.

Will a fiance visa be the best option to bring my boyfriend to the US?

default-avatar
Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
If you don't have the time or resources to get married in Mexico, you can petition for your boyfriend to come to the US on a fiance visa. After you are married in the US, he can apply for adjustment of status on form I-485 and get his green card without having to return to Mexico. On average, the entire fiance/adjustment of status process is slightly longer and more expensive than getting married in Mexico and sponsoring for your husband on a I-130 relative petition, but he will probably arrive in the US quicker.
