Can I withdraw by K1 and convert it to an L1-B visa?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You are not going to be issued a L1 non-immigrant visa when your intent is to be an immigrant since your are married to a U.S. Citizen. You have to withdraw your K1 application and have your husband file an I-130 petition for you. While it will take awhile it is the correct way to do it and will prevent you from having problems getting your Green Card.

Will I be able to keep my 10-year green card after divorce?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Since you already have the ten year green card, you should have no problems keeping it unless there was fraud or misrepresentation in its acquisition and the Department of Homeland Security discovers it. Kindly note that if you later apply for citizenship, you may be asked questions concerning your prior marriage since that was how you got your green card.
