Emigrate to the United States

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An initial question would be whether you or your wife are able to receive job offers in your respective fields. If you are able to do so, and if you both have the equivalent of US baccalaureate degrees either through equivalent degrees or a combination of education and working experience, you may be able to obtain working visas under the E-3 visa for Australians. You can also at a later point be sponsored for permanent residence through the labor certification process which would depend upon the wishes of your employer. If you do not have a job offer from a US employer, you may be able to establish your own business in the US and live here for many years through an E-2 investor visa which, while not a permanent resident visa, is a long term one under which you would be allowed to continually work in your own investment.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What rights do I have as a sponsored fiancee if my fiance refuses to marry me?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
Likely none. You are required to return to your country 90 days after admission. If he decides to marry you after 90 days, then there maybe possibilities. However, this is quite a risk with no assurances that he will change his mind. I strongly recommend an appointment with a competent and experienced immigration and visa attorney before mistakes are made, Which may even include your departure from the United States. I have practiced immigration and visa law for nearly 20 years. The above is general information, not legal advice, and does not create an attorney-client relationship.
