Will my n400 application be denied?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hello. The USCIS may ask more details about your first marriage. Although you got the 10 year card, they still reserve the right to review that first case/marriage. However, if you had strong proof the first case was real and bona fide, it should be fine. The same thing may happen if and when you file for your new husband's green card. They will investigate your first marriage.

Why don't you ask him? I don't know what your motive is. If you are trying to help him, ask him to come and see me or post the question directly.

If you leave the country now, then you will trigger a 3 year bar of inadmissibility since you have accrued over 180 days in unlawful presence. Please consult with an immigration lawyer before filing any documents or departing the U.S.
