Once you are married she is eligible to obtain a J-2 at the consulate. Once in the U.S. she is also eligible to apply for a work card so long as you can show her income is not necessary for your support.

Your husband has no power over you at this point in terms of your immigration status. He cannot petition to have your status taken or use his status as a USC or your spouse to have it removed from you. I have seen vengeful ex's try to claim that the marriage was fake when it clearly was not, but you will be able to overcome that with proof of joint documents, photos, etc and your own testimony.

If your wife is on a legitimate H1b in the US, the consulate should give her the H-1B visa provided she did not have the intention to change her status before she entered the US. She will want to bring the entire H pack, letter from employer and current paystub. There is no guarantee with any US consulate however as long as there is not fraud/misrepresentation, they should issue that visa or the H-4, as it will still be available to her.
