I know you may not want to hear this but your family should pay for a consultation with an experienced Immigration Attorney to review all aspects of your case. Any arrest may pose serious immigration consequences. The money spent may be well worth the investment, but do it BEFORE it is too late. Can we apply for one first, and once approved, can that person be the co-sponsor for the affidavit of support of the second applicant?

If the co-sponsor's documentable income is insufficient for serving as a co-sponsor on two applications filed at the same time, his/her income will be insufficient for serving as a co-sponsor on two applications filed separately (unless the second application is filed after the first one becomes terminated through expiration of 10 years, through naturalization, through death, etc.). When filing as a co-sponsor, the co-sponsor must identify his/her family size and also identify any other person for whom he/she serves as a sponsor/co-sponsor. This issue is just one of many in the application process that can be significantly more complex than it might first appear. Improper preparation of an application or insufficient supporting documentation can cause long delays or even more harsh consequences, and it would be wise to work with an immigration attorney.

There is unfortunately no relationship between you and your daughter-in-law that would allow you to petition for her. Unless she has some other relative who is sponsoring her or can sponsor her within a short period of time, or an employment opportunity in the US, she would likely have to wait until your grandson reaches the age of 21 to petition for her assuming that he is a US citizen by that time and that the law has not changed to disallow petitions of US citizens for their parents.
