You can divorce your husband at anytime you deem proper. However, if he only has a conditional green card that is valid for 2 years, he will be on his own when he applies to remove the conditions on his residency on Form I-751. If he has a green card that is valid for 10 years, then he probably will not have any problems with immigration.

She can file an I-589 to request an extension. She will need to demonstrate how she will support herself in the US and why she is staying.

Unfortunately, children brought here are currently under the same law as everyone else. This is why there is urgent need of the DREAM act. I would suggest calling your Senator and representative and urge passage of this act.
