You are not required to submit form I-131 when you apply for adjustment of status. The application can be submitted free of charge at any time while your I-485 application is still pending before USCIS. You will also need to submit a copy of the I-485 receipt notice along with the application.

If you believe that your present attorney has not fulfilled your agreement and has taken your monies, you should first write to him or her explaining why your contract has been breached and asking for an immediate refund. Failing to obtain a favorable resolution within a reasonable period of time, you can make a complaint to the local Bar Association setting out the reasons for which you believe the lawyer breached his or her ethical duty to you.
