You cannot file for your mother in law. You wife has to do it and she need to be a US citizen to file a petition for her mother.

You can start a new petition for your mother, but you have to be at least 21 years of age. You will also need to submit an affidavit of support when your mother applies for her immigrant visa. If you do not meet the minimum financial requirement, you or your mother will can use up to 2 joint sponsors to meet the requirement.

If he is serving time for a criminal conviction, he would need to talk to his criminal defense attorney about getting out.  As far as immigration goes, I can't see any way he can return to the US legally.  He is subject to a lifetime bar if what you say is correct.
