Those are very good questions. Your I-94 probably reads D/S which stands for duration of status. Is your J-1 visa subject to INA 212(e) (foreign residency requirement ). If you are concerned that you may be in the U.S. now in violation of the law, you act to fix your status soon.

It is difficult to answer that question without more information.  In principle, you do not have legal status in the US and are subject to deportation to your home country.  It may, under certain circumstances, be possible to get relief from deportation, but that would depend upon the facts of your case.  How long have you been in the US, how old is your son, is he a US citizen etc.  These are all relevant factors that a competent immgration attorney would need to know.  Best of luck

Hi. Your mother can file for you, but it will not provide any immediate immigration benefits. It will not give you the right to stay here while it processes. That is only possible if she were a citizen.  If you overstay and leave you may be subject to different bars from returning. She would need to naturalize before you turn 21 to process now and stay.
