Even after being outside the U.S. for 10 years he still may be inadmissible due to the multiple felonies. Also, since at least one of the convictions involves drugs he may be permanently barred from immigrating the U.S. Under Section 212(a)(2)(A)(II) and 212(a)(2)(C), individuals who have used drugs in the past, or who have sold drugs in the past are barred from immigrating to the U.S..

This gives him a place in line to get a visa to immigrate. In December these cases were only taking a few months but in January the Visa Bulletin retrogresses by a couple of years. We are hopeful that in February there will be forward movement again. In the meantime you can also explore nonimmigrant options for him to be here while he is waiting for the immigrant visa queue to progress or you to become a U.S. citizen.
