Do you think they will approve my petition?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Do not bother to apply until after you visit him again as the 2 year rule is strict. If you want to get married over there you could petition for him to come as an immigrant and he would have the right work when he enters the U.S. If you decide to do this or the fiance we can prepare documents for you to take with you and get signed to save time.

Are interviewers allowed to ask about very personal questions to get citizenship?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A skilled USCIS adjudicator should be able to assess whether a couple is living together in a bona fide marriage without asking about the couple's sex life. An attorney representing a client at an adjustment of status interview, knowing the client's discomfort discussing the couple's sex life, would be wise to instruct the client not to answer and to request of the adjudicator (or his/her supervisor) that other questions be posed to probe the validity of the marriage. A couple's sex life is not properly the business of the U.S. Federal Government acting through its agents at the USCIS.
