Who can adjust a person's immigration status in the USA?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
There are many circumstances when this can be done. It is quite complicated and would definitely require an initial consultation with our office.

More than likely, you will not have a problem coming back to the US. The fact that you have not been convicted or pleaded guilty to the charge is in your favor. You should be aware, however, of something called prudential revocation of a visa in which the American consulate or embassy overseas hears about your arrest and revokes the visa. If you are outside the country when that is done, you will lose your ability to return on that particular visa. Can I get a greencard if I've been deported but am married to an American?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
It depends on the reason for the deportation and if you qualify for a waiver for the underlying immigration violation and if your spouse and child can meet the extreme and unusual hardship standard for you to qualify for the waiver.
