How can I help my wife who was arrested for failure to go through with the voluntary removal?

Answered by attorney Sufen Hilf
Immigration lawyer at Hilf & Hilf PLC
Your wife had an outstanding removal order. She needs probably a motion to reopen her case if possible. That is the only way to get her out.

Is it possible to apply from current status of F1-OPT to EB2 (Schedule A) to obtain greencard?

Justin Wang

your employer can file I-140, and if your priority date is current, even I-485 to adjust status, while you are on OPT. ?If you want to include your fiancee you must marry her before you submit her I-485. Please note though even if you has a master's degree in nursing, you may or may be eligible for EB2 depending on the standard requirement in your job. Please consult an immigration lawyer for details.
