Is US visitor visa still valid for some who overstayed US visit by 2 days before

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Unfortunately, a US visitor visa is automatically revoked once the visa holder violates nonimmigrant status while in the US, even by two days. The parents could encounter a problem in entering the US with the same visas in the future. It is safer to apply for visas again explaining the circumstances of what happened. Can I petition for my step-dad to get his green card?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Yes. Both you and your mother are able to submit a relative petition on behalf of your stepfather. Your petition should be processed faster because he is considered an immediate relative of a U.S. Citizen. However, you should consult with an immigration attorney before starting the process because he may have issues of inadmissibilities.
