Can my parents apply for citizenship if they entered illegally?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Are your parents permanent residents now? If you are currently illegal along with your parents the first status to seek would be permanent residency if you have a sponsor. These are complicated cases to work through so I suggest you consult an attorney to evaluate both your parents' cases and your own and advise you of your options. If you want to schedule a consultation you may contact me as indicated below; we do charge for consultations but whatever fee you pay for the consultation would then be a credit toward the fees of your case if you retain me for work beyond the consultation.

How long is the I130 application process?

default-avatar
Answered by attorney David H Stoller (Unclaimed Profile)
Immigration lawyer at Stoller & Moreno, P.A.
Average processing time for an I-130 is at about 6 months so it would appear that your application is well within normal time frame. On the issue of how long it will take your spouse to get to the US, that would depend on whether he has any prior or current immigration issues that would create any delay in the overseas processing of his case. Unfortunately, there is not sufficient information in your inquiry to answer that question. Generally, the average processing time on a "clean" case without any issues is between 3-6 months.
