Do I need to leave US after I married to US citizen and my student visa expires?

Answered by attorney Eric Arden Fisher (Unclaimed Profile)
Immigration lawyer at The Law Office of Eric A. Fisher, LLC
Your spouse should file an I-130 petition the same time you file the I-485 adjustment of status application. The filing fees are $1490 for the two together. If you file an I-131 application for advance parole, you can travel if it is approved while the adjustment application is being processed. Otherwise, you should stay in the US even after your F1 status expires, until the adjustment is approved.

Your criminal history, even as a juvenile, will be relevant and could result in a denial. You should get copies of all police reports and court records, and meet with an immigration attorney before applying for Deferred Action.

When should we apply for I 601A waiver?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
You should file the I-130 immediately to shorten the time for her priority date to become current. It's currently taking at least 7 years for the F1 category. Only immediate relatives can apply for an I-601A provisional waiver. Since your daughter is already over the age of 21, she can no longer qualify as an immediate relative, even if you become a US citizen.
