Do I look bad if I file and do I need to be divorced?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Sorry to hear about your husband's abusive conduct and your need for a divorce. If you already have been a Permanent Resident for six years, you likely are eligible to apply now to become a naturalized U.S. citizen, and this is true regardless of whether your marriage terminated in divorce approximately six years after you adjusted status, and regardless of who is identified as the petitioner in a divorce proceeding. It would be wise for you to confer with an immigration attorney to address your immigration situation and eligibility for naturalization, and for you to confer with a domestic relations/divorce attorney about rights and responsibilities relating to a divorce. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

If spouses is married since 2012 but living apart in two cities, how can they get a green card?

Answered by attorney Lana Vladimirovna Kurilova Rich (Unclaimed Profile)
Immigration lawyer at Lana Kurilova Rich PLLC
This is not good; you would have to prove that your marriage is genuine. You have no home together. Any joint bank accounts? Any bills together? Car? Insurance? Anything? If your marriage is true, you may want to find a way to move in together and start living together before you file. Otherwise, especially given the age difference, you may have a problem.

If you have physically met in the past 2 years, he would be eligible for the K-1 fiance visa. No significant difference in the K-1 versus the K-3 visa. ou.
