What is the best way for my fiance to get legal?

Answered by attorney Lisa Ellen Seifert (Unclaimed Profile)
Immigration lawyer at Seifert Law Offices PLLC
Anyone who has been here illegally for over a year should not leave.... If he does, it is a 10 year bar to return... and if he returns, he will throw away absolutely any chance of becoming legal. More than one illegal entry no options. So, please seek in person advice from a competent immigration attorney as soon as possible. And before your fiance makes final plans to leave.

Can my husband qualify to work legally?

Alan Rodolfo Diamante

There is a 10 year bar for unlawful reentry after being removed. He would have to leave for 10 years. Unless he was a victim of certain offenses (look up the U-visa).

If he is in the US, then the process takes about 3 months from start to finish. You must file some forms, get fingerprinted and be interview by a USCIS Officer. If he is outside the US, then process takes about a year.
