J1 teach program- change to H status

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
From your question, I assume that your J-1 visa has a two-year foreign residence requirement attached to it. The school district is allowed to hire you under H-1B visa status once you are free of the 2 year home residence requirement attached to the J-1 visa. Your sponsor does not have to give consent for the change of status once your J visa obligation is fulfilled. If the school district is thinking of sponsoring you and there is no cap quota for new H-1B cases, you should ensure that it is exempt from the requirement of a cap number. Can I bring my stepson and stepdaughter from the Dominican Republic to live in the USA if I’m a US citizen?

Yes. As long as you married your stepchildren's father before their 18th birthday and are still legally married to the father, you can file a petition for them.

I am a US citizen living in Mexico, my boyfriend lives in the US & entered the country legally. Can we marry in Mexico and petition for his residency?

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Yes if your boyfriend exits the USA he then will become subject to either a 3 or 10 year bar depending upon how much unlawful presence he has accumulated. To get around that he would have to file a waiver and proof of extreme hardship would need to be shown. Your best and safest bet is to relocate to the USA and process his paperwork here. My advice is to retain counsel to pursue the safest strategy for success. Every case is unique and every case must be delicately handled to assure the best chance of success.
