After NVC receives an approve case from USCIS how long will it takes for the consulate and medical appointments

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hi. If you paid the fees and sent the proper documentation, they will usually get back to you in a month. If everything is ok, they will send notice of the interview date. That varies between consulates. But, is generally 1-3 months more. Good Luck!

Can I bring my wife to the United States if I am a green card holder?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You have to petition your wife by filing an I-130 petition. Since you are a legal permanent resident it will take 3 to 5 years for her to be able to immigrant to the U.S. If you were married at the time you got your Green Card you wife may qualify as a derivative beneficiary. If so, it would take 6-12 months for her to immigrant to the U.S.

Should a receipt # be generated or is it enough if the petition is filed within the 60 day window to be considered in status.

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
It is sufficient that a petition be filed within the 60 day grace period for an H-1B transfer. A receipt is not required as long as the petition is properly filed and not rejected for any errors. I note that USCIS has been giving warning that its issuance of receipts is delayed.
