Can someone who is out of status here in the US get f2 visa

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
To obtain a change of status to F-2, the applicant must be in valid nonimmigrant status. U.S.C.I.S. does make a few exceptions, but the rule of thumb is that the privilege of change of status requires the maintenance of a current immigration status.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Do I have to state a foreign citation on my naturalization form?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The naturalization form requests information on all arrests and citations whether in the US or overseas. You should present proof of your payment of the fine. If there was an arrest record, you should obtain that also. Can my step father sponsor me to prevent my deportation?

default-avatar
Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
Are you in deportation/removal proceedings? Yes, your step-father can file for you as the marriage creating the step-parent relationship was completed prior to you turning 18. You are now an adult unmarried child of a US citizen, FB-1, with a priority date backlog of seven years. You should consult with an experienced immigration attorney that can analyze the timeline of your case to determine if you are eligible for other benefits. Did your mother naturalize? When?
