If you are a US citizen or a lawful permanent resident, you can file a petition for your spouse. Whether or not he could file for legal status depends upon many things, so you should consult an immigration attorney.

Application for citizenship

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The three-year rule for citizenship from marriage to a US citizen contemplates that the applicant will either have been a conditional or green card holder for three years, that the US citizen has held citizenship status for three years, and that the couple have been living together on a constant basis for the three years. Under those circumstances, an application can be made 90 days before the three-year mark as long as only the first condition is at issue. If the green card that you received is your first green card and you did not receive a conditional card previously, you would have to wait three years. If you previously received a conditional card, the time to start counting for citizenship would begin with the award of the conditional green card. This process usually takes a couple of months. But you can remain in the US and don't need to apply for a visa.
