You need to consult with an immigration attorney as well as a ceruminal attorney or use someone who does both. What you said in the description of the problem does not make sense to me. You say you are guilty but it wasn't you. Did you do it or not? If it wasn't you then you are not guilty. If that is the case you should try the case and be found not guilty, then there will be no immigration problem. Since you are a US citizen, you can file the I-130 and she should file the I-485 adjustment of status to a permanent resident based upon marriage. The forms will include entries requesting the interviews take place in the USA, so she does not have to leave the country.

Many states require an unexpired ID (passport, etc) to get married. It is a complex process to sponsor an undocumented spouse, but the starting point is the I-130 package.
