What are the steps to take to make my future husband legal in the United States?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
If your fiance entered the US legally and you are a US citizen, you will need to petition for him on form I-130 and your fiance will need to apply for adjustment of status on form I-485 concurrently after you have been married. The application fees will total $1,490.

Can i come to US if my visa is not expired yet?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you have a visa which is valid until June 2014, you are allowed to enter the US during the period of its validity. I do note that you will be inspected by Customs and Border Protection and you will have to show that your intention to come to the US is consistent with the visa. For example, if you have a visitor's visa and have been in the US for most of the past year, there might be concern that you are abusing the visa and that instead of visiting here, you are actually visiting the Ukraine. However, if you have been properly using the visa, you should have no problems with your entry. yeah and what is in it and what I'm fineDue to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What do I do if my husband has been deported?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Aggravated felony conviction made your husband subject to a mandatory deportation and ineligible for any relief under the immigration law. In other words, it means that he will never again be permitted to enter the United States. It does not matter that he was in the U.S. legally, or was married to you for 10 years, or that he has children. The only hope is that he might have been a U.S. citizen: if his grandfather was a U.S. citizen, then his descendants might be citizens, too. There is a law that, under certain conditions, children of U.S. citizens automatically become U.S. citizens - without filing any applications or documents. This law was changing over the years, and the conditions it set were changing, too. So you have to talk to an immigration attorney and answer his or her questions about your husband's family (when and how his grandfather became a U.S. citizen, when and where your husband's parent-the grandfather's child was born, etc.) If it turns out that your husband is a U.S. citizen "by operation of law" then his deportation was without authority of the law and can be reversed.
