How can my illegal husband apply for a work visa for now until we get his green card

Samuel Joseph Zermeno
Answered by attorney Samuel Joseph Zermeno (Unclaimed Profile)
Immigration lawyer at Zermeno Law
Hello. If you husband is staturtorily eligible for cancellation of removal he can apply for a work permit before his next court date.  If he doesn't have an attorney for his removal proceeding I highly recommend he gets one as soon as possible.  Removal proceedings are very difficult and effective representation should be sought. Please call for a free consultation, I represent clients throughout the US.

How does my arrest record affect the I-485 application?

Unless you admit to the elements of a crime, only a conviction can be used against you. However, during the processing of your application, immigration may request you to provide certified copies of the arrest report and court disposition. Unless you provide them with those records or documentation from Canada (a letter from the police or court) that the records are unavailable or could not be found, immigration may still deny your case for failing to respond to a request for evidence.

Can I marry my girlfriend who has a Bussines Visa, and make her papers, while I am an asylum granted person?

Answered by attorney Eric Arden Fisher (Unclaimed Profile)
Immigration lawyer at The Law Office of Eric A. Fisher, LLC
If you were granted asylum in February 2011, you can file an application to become a lawful permanent resident ("LPR") next year, February 2012. If and when you are granted LPR status, you can file a visa petition for your wife. I would need to know much more before giving any advice on how long it could take to "regulate her status."
