Extend a visa

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Usually visitors to the US are given six months at entry unless there are other factors in their case, at which time Customs and Border Protection can give a lesser amount of time. If you are indeed given a much smaller amount of time to stay, you should check the entry stamp to see whether there was something written there that would preclude change of status or extension of status. If not, you can extend a period of stay through filing form I-539 Application to Extend/Change Nonimmigrant Status with appropriate fee to the U.S.C.I.S. service center having jurisdiction over your place of residence.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. How can I have my fiancee come to the US while I am in the hospital?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
If your main purpose is for her to assist you, she should apply for B2 visa. If your main reason is for her to come here to marry you, then you should file K-1 visa for her. File the visa application with the USCIS. It may take several months(3 month average) for the USCIS to adjudicate the application. It may take additional 3-4 months for the US embassy to issue the K-1 visa.

She may have to adjust her status through consular processing. See an immigration attorney to see if there is another alternative.
