I would file an amended return claiming married filing separately.  It is not correct that she is single and you shouldn't file an incorrect return.  Give the amended return to the immigration service in support of the I-864.

I understand your frustration. Immigration law is a confusing area of the law. what to file, when and where depends on your husband's immigration history. The one thing I can tell you is that yes you will need a waiver. I would file the I-130 and the waiver called consent or permission to apply. Then at the embassy you will need to file another waiver.

If you leave 5 days versus 25 days after a denial, it should make no difference under the law, as you are still leaving while out of status, and the 3-year bar would not have kicked in for a few weeks out of status.
