I just learned that my boyfriend is here on a work visa is it illegal to marry him

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
OK so generally speaking, any alien who enters the country with legal permission, and thereafter gets married to a US citizen, is allowed to adjust status to get his green card. However that is the general rule and there are exceptions. So you need to discuss your case in detail with counsel to make sure that he would qualify if in fact he goes ahead and gets married to you.

J1 teach program- change to H status

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
From your question, I assume that your J-1 visa has a two-year foreign residence requirement attached to it. The school district is allowed to hire you under H-1B visa status once you are free of the 2 year home residence requirement attached to the J-1 visa. Your sponsor does not have to give consent for the change of status once your J visa obligation is fulfilled. If the school district is thinking of sponsoring you and there is no cap quota for new H-1B cases, you should ensure that it is exempt from the requirement of a cap number. Consider retaining counsel to handle all steps from A to Z for a smooth pathway to a successful outcome. Counsel anywhere in the USA can help. Good luck.
