I'm not sure there's any short answer. If you feel you are the victim of fraud, then you could report him to ICE. His immigration status is between him and the government, so there's not much for you to do other than to complain, perhaps, to the government if you feel you are a victim of some illegal conduct.

If you are not residing with your husband or you divorce, you will need to qualify based on 5 years of residency. Therefore, you can file 90 days before your 5th anniversary of residency.

If your wife is attempting to get her green card on the basis of marriage, any immigration officer or US consular official adjudicating or permanent resident application will want to see evidence of the bona fide character of your marriage. One indicia is whether the couple are filing joint tax returns. In cases where the alien spouse is overseas, and has never lived with the US citizen or permanent resident petitioner in the States, consular officials are more understanding as to why there is no joint tax return. Where the alien beneficiary is in the States after the marriage is celebrated, USCIS officers by and large in our experience usually expect to see joint tax returns or a good explanation why not.
