My daughter is an USA citizen and is filing an I130 form for me. Can I stay or do I have to leave Before my legal status is due on June

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
If your daughter is over 21 then she can sponsor you as an immediate relative. Since you entered as a visitor then u may have a problem adjusting status since your intent was to visit and not to adjust status. Consequently it would be safer for u to process your petition overseas. Thus u should not overstay your visa if u don’t want any problems.

Can I reapply if my petition of naturalization was denied?

Normally when you apply at 3 years from obtaining your residency your marriage must be in good standing in order to receive your citizenship. If you apply at 5 years then your marriage does not come into play. If the USCIS determines you committed Fraud at the last application process you could have issues getting your Nat'l approved.

Can I marry her directly with the help of this country’s DIVORCE certificate or I have to DIVORCE in US too, with my ex-wife?

Answered by attorney Richard Stephan Kolomejec (Unclaimed Profile)
Immigration lawyer at Richard S. Kolomejec
USCIS will recognize foreign divorces. So you can marry a US citizen without having to reapply for the divorce in the US. If done right, you should be able to get a green card in about 3 months.
