Should we get married in another country and then apply for a visa?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Significantly more information is needed in order to assess the options, including information about your boyfriend's age, the date he entered the U.S. unlawfully and without inspection, and whether anyone may have filed an immigration petition for him. There is no substitute for reviewing all of the facts carefully with an immigration lawyer.

Would it be a good idea to schedule an interview with the officer again or should I wait longer?

Answered by attorney David Nabow Soloway

It is not common for it to take a long time between completion of a naturalization interview/examination and the scheduling of an oath ceremony. If you were represented by an immigration attorney who was familiar with what you described as a "complicated case," the attorney could advise you about the likely reasons for the delay, or, better yet, have prepared your case in a way most likely to avert a delay. Additionally, that attorney would be in a position about the most productive steps to consider taking at this time, such as a formal Liaison Inquiry through the USCIS/American Immigration Lawyers Association liaison process, seeking assistance through the Office of the Ombudsman, seeking assistance through the immigration representative of your U.S. senator's office, through filing a Mandamus Lawsuit, etc.

You will need to apply for a fiance visa, and yes, you will have to get married within 90 days, or leave.
