Can I still apply for asylum after five years?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Generally you have only 1 year from the date that you enter the U.S. to apply for asylum. After that your asylum claim is barred and you can no longer apply for or be granted asylum. With that being said, there are limited exceptions and circumstances where an asylum application is possible after the 1 year. I suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

It's faster to do a fiancee visa, but it may be less expensive overall to apply for her immigrant visa.

How long must I work to be able to prove that I am able to complete with the requirements of the affidavit of support?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
It is your current income that counts. You do not need to work for any specific time prior to the application, you need to show that you have a job NOW. If you do not have a job now, you can find a joint sponsor.
