I am assuming that you are a U.S. citizen. You can file a petition for your husband. The whole process usually takes approximately 6 months to 1 year. If your husband has proof of admission, he can adjudicate his petition here. If not, he may have to go back to his country for consular processing.

To reenter the country as a visitor now, immigration may first require you to apply for permission to reenter after having been deported. The application is filed on form I-212.

Does he have any criminal arrests, charges or convictions? Did anyone file a preference petition or labor certification for him prior to April 30, 2001?
