Will DACA make it easier because I already have a work permit or will they make it difficult?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
Your Deferred Action approval is a different process than a marriage-based immigration case. In fact, you should consider consulting with an immigration attorney to make sure you're eligible to obtain your green card through an adjustment of status process. If you're not eligible, and consular processing is required, you need to make sure you are admissible to re-enter the US.

Can I still get a green card if I go back to my home country for now?

I would highly suggest you apply for a re-entry permit before leaving as that will give you two years to stay out of the country. It is always better to be prepared in case you change your mind and decide you want to return.

What should I do to remove my conditional residence?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)

Ideally, you want to file your I-751 within the 90 day period before the conditional green card expires. You can file without your wife but need that finalized divorce at some point during your green card process. I am happy to do a full consultation with you, to analyze your case and review all options. A consult is about one hour and my flat fee is $150. Otherwise I really do encourage you to have a consult with another competent immigration attorney. Again, you can file on your own as long as you meet all requirements!
