The best option would seem to be filing a new I-130 application if you marry your boyfriend.  He will need a waiver for his illegal presence if he has overstayed but that should not be a significant problem. Contact us to arrange a consultation to see if this course of action is best for you.

How can I marry my boyfriend when my visa is near expiration?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
The validity of your visa has no effect on your eligibility to get married. You should wait until your divorce in the Philippines is finalized before getting married to your American fiance. After your marriage, your husband can petition for you to come live in the US as his spouse. The petition is filed on form I-130.

Looking to marry in 3 months, & start i130. girl lives outside US. I want her to visit. Will visit visa rejection impact I-130? Advisable to wait?

If you are a US citizen then you can sponsor your fiancé for a green card. You should discuss your case with counsel and process the entire case with your attorney. If you are not a US citizen the wait times will be significantly longer to obtain her green card.
