What do I do if I have a student visa and overstayed?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
If you are marrying a US citizen your overstay will be forgiven. Do not travel until you obtain permission to do so. You really should consult with an immigration attorney before filing any paperwork to protect your status.

Will my boyfriend be deported?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
If he has no basis for US permanent residence and is illegal in the US, then he will be deported. Are you engaged to him? If you marry, there is a possibility that he could get permanent residence or an immigrant visa to return to the US. Please call me to discuss details of his case.

I was deported 2009 the judge say stay out of trouble for five years and u can come back I have been out of the usa for ten years how can i get back

If the only issue was a removal proceeding involving illegal stay and not crime or fraud or other ground of inadmissibility, you would either apply for a nonimmigrant or immigrant visa if you are eligible for such. For example, if you applied for a visitors visa, you would disclose the fact of the deportation and it would be up to the consular officer whether to issue the visa dependent upon whether he or she believed that you had the proper nonimmigrant intent.
