Visas generally fall into two categories: those that are based upon a family relationship and those that are related to employment, and there are extensive details about eligibility for each type of visa. After examining eligibilities, the next step generally is to review the pros and cons of each option in order to select the option that best suits the goals of the foreign national; this includes such things as the time needed to achieve success, the costs involved with each option, the likelihood of success, etc. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

Hi Andrew. You may qualify for a green card but you will have to file an unlawful presence waiver. Because your future spouse and you have a child together your spouse would suffer hardship if you were not allowed a green card. The hardship must result to her if you’re not allowed to stay here and that may be likely if you are now a family with a minor child. Counsel  anywhere in the USA can help you. Call to discuss.

You are correct in understanding that in some circumstances the USCIS may treat pretrial diversion and other dispositions of a criminal arrest the same as if it were a "conviction" for immigration-related purposes. You are also correct in understanding that if the dismissal did not involve an admission of the underlying elements of the alleged crime, the USCIS will not consider the pretrial diversion to be the equivalent of a conviction.
