Will the shoplifting charge affect me or deny when filing for my citizenship?

Answered by attorney Peter S Kollory (Unclaimed Profile)
Immigration lawyer at The Law Offices of Peter S. Kollory
Much depends on how you plead at the municipal court. Some guilty pleas have serious consequences in the immigration law. Further, depends on the of law the residence in the state the shoplifting took place. You need to consult an attorney who has a background in criminal law and immigration law, or who handled similar cases.

H1 max out is ending on Sep30,22 Perm is not approved. If I apply for COS to B1/B2, am I allowed to stay in USA until COS is approved?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
A timely request for change of status allows an individual to remain in the US until the time that it is adjudicated. Technically, you are not in legal nonimmigrant status unless the change of status application is approved. However, you would not begin to accrue unlawful presence until 180 days after the change of status application is denied. Hopefully, this will assist you in planning your future immigration steps. Can I apply for a work visa or a student visa if I am on a B1B2 visa with my family?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
If you are in the U.S. and in-status (B-1/B-2) you can certainly file to extend or change your non immigrant visa status. However, the query is what to change it to. If you are changing to a work visa that would be hard since there are few classifications that would be available. If it is a student visa you are seeking, then you can try to change in the U.S. or take the I-20 to the Consulate abroad for a stamping. There are many nuances to the information you seek and it is a good idea for you to consider enlisting the services of a qualified immigration lawyer or legal counselor.
