If not still in status then you will need to leave. In the meantime you can apply for another nonimmigrant status if you would qualify.

An I-130 can be approved whether or not you are subject to the 2 year physical presence requirement. You should be able to file your I-130 / Application to adjust status based on marriage to an American citizen (provided you are other admissible).

It is against the current policy of the government, but Department of Homeland Security can do it. You need to find a competent immigration law attorney as soon as possible to try stopping your son's deportation, because once he is deported, it will be largely impossible to bring him back in the next 10 years.
